Ugandan businessman Mukesh Babubhai Shukla has been ordered by the High Court to pay Ush14 billion ($3.9 million) for illegally occupying Shumuk House, formerly Katatumba Suites, in central Kampala. This concludes a decade-long dispute with the family of the late Bonney Mwebesa Katatumba, a prominent businessman and former Pakistani consul to Uganda.
Shukla fined over fraudulent property dealings
Since 2008, Shukla has held the property, but ownership became the subject of a prolonged legal dispute with the family of the late Bonney Mwebesa Katatumba. The family argued that the transactions transferring the property to Shukla were improperly executed and fraudulent.
Shukla’s claims over other assets, including the Hotel Diplomate in Muyenga and a resort on Banda Island, were previously dismissed by courts in 2014, 2020, and 2021 due to forgery and lack of spousal consent. Noncompliance could result in enforcement actions such as asset seizure or eviction.
The long legal saga of Mukesh Shukla
Mukesh Shukla, executive director of Shumuk Aluminum Industries Ltd., rose to prominence in Uganda through ventures in aluminum manufacturing, real estate, and hospitality.
The building, however, became the center of a protracted legal battle with the family of the late Bonney Mwebesa Katatumba, who argued that the transactions leading to Shukla’s possession were fraudulent and improperly executed.
Katatumba family reclaims historic property
Regardless of the prominence of the parties involved, it is a crucial step for the Katatumba family to reclaim their father’s estate and to uphold the idea that historical property disputes are subject to judicial scrutiny.
The ruling is a significant step in the Katatumba family’s quest to recover their father’s estate, which has been embroiled in legal proceedings for more than ten years. The enforcement of the $3.9 million award is a crucial development to keep an eye on in Uganda’s business and real estate landscape, as Shukla’s legal team has not indicated whether they will file an appeal.
